The information contained herein is based on laws and requirements for the City of Winter Garden elections.

The following information is not intended to constitute all the information contained in the City's Charter and Code of Ordinances on this subject, therefore, please refer to Article II of the revised City Charter (effective September 25, 2007) and Chapter 2, Article V of the Code of Ordinances.

Qualifications of Candidates for Mayor & City Commission

  • Shall have been a resident of the city and district in which you run for one (1) year
    immediately prior to the end of qualifying.
  • Shall have been a registered voter in the district in which you run for one (1) year
    immediately prior to the end of qualifying.
  • Shall not hold any other public office, except that of notary public, an office in the National Guard, or an office in the organized reserve of the armed forces of the United States.

At-Large Candidates

Only the Mayor’s seat (District 5) is elected at-large by all registered voters.

Election Dates and Terms of Office

The regular City election is held the second Tuesday in March of each year and is for a term of three (3) years.  No election is required if the incumbent is unopposed.

Non-partisan Elections

All elections are conducted on a non-partisan basis without any designation of political party affiliation.

Qualifying

Begins at noon the 3rd Tuesday in January and ends at noon on the 7th day after the date registration commences.  The qualifying fee is 1% of the annual salary of the office sought plus a $15 filling fee.

Order of seats elected

  • Mayor and District 1 Commission seats are to be elected in 2008, 2011, 2014, 2017, 2020 ….
  • Districts 2, 3, and 4 Commission seats are elected 2009, 2012, 2015, 2018, 2021...

    No elections are scheduled in 2010, 2013, 2016, 2019, 2022 …...

City Canvassing Board

The City Canvassing Board consists of the City Clerk and two (2) citizens appointed annually by the City Commission. Additionally, two citizens are appointed by the City Commission to serve as alternate members.

After the polls close on Election Day, the board shall meet and proceed to canvass any absentee and provisional ballots cast. After canvassing the board shall cause the City Clerk to prepare a certificate, containing the total number of votes cast for each person or other measure voted upon, on which each Canvassing Board member present will sign the official certificate of election results.

Note: The City Commission may deem it necessary to delegate canvassing board duties to the Orange County Supervisor of Elections.

Term Begins
At the next regularly scheduled City Commission meeting after the election and oath of office is administered.

Run-off Election (if necessary)

Second Tuesday in April.
